Chilli Beans retoma nome de domínio depois de golpe da concorrência

A Chilli Beans, maior rede brasileira especializada em óculos escuros, retomou o direito de uso do nome de domínio "chillibeans.com" na internet por meio de uma decisão arbitral do Centro de Mediação e Arbitragem da Organização Mundial da Propriedade Intelectual (Ompi).

A empresa conseguiu provar que o nome não poderia ser considerado de uso comum, apesar de se referir a pratos típicos da culinária mexicana. O nome de domínio havia sido registrado por uma empresa localizada nas Ilhas Cayman, que costuma operar milhares de nomes de domínio genéricos usados para sites contendo os chamados "links patrocinados" - serviços oferecidos por sites de buscas em que uma empresa paga para que seu nome apareça cada vez que um internauta digita determinadas palavras ao fazer uma pesquisa.

Desde 1999, a International Corporation for Assigned Names and Numbers (Icann), entidade responsável pela distribuição do espaço para endereços eletrônicos internacionais, adotou a política de resolução de disputas sobre nomes de domínio por meio de centros conveniados de arbitragem. Neles são resolvidos apenas conflitos de domínios com terminações genéricas, como ".com" e ".net", já que disputas relacionadas aos nomes com terminações do código do país dependem da regulamentação de cada nação.

A Chilli Beans já possuía o domínio nacional ".br", além do registro internacional da marca. Para conseguir de volta o domínio estrangeiro ".com", em posse da empresa das Ilhas Cayman, demonstrou que os links patrocinados da página anunciavam sites que vendiam óculos escuros de concorrentes da empresa.

A empresa também alegou que cerca de 75% do tráfego do site era proveniente do Brasil. Os árbitros que decidiram o caso consideraram que o registro e o uso do domínio poderia ser considerado de má-fé, pois aparentemente seu titular não apenas deixou de verificar se violaria direitos alheios como também "fechou os olhos" ao aproveitamento da fama da marca alheia.

Para Kenneth Wallace, do escritório Barros e Souza Advogados, que defende a Chilli Beans, a decisão é interessante por ter considerado que o fato de um nome de domínio ser genérico ou equivaler a uma palavra dicionarizada não exime os registradores de tomarem precauções no momento do registro e quanto ao conteúdo do site para evitar a violação de direitos de marca de terceiros. Se não houver questionamento judicial da decisão arbitral no prazo de dez dias, contados da notificação da decisão, o domínio será transferido definitivamente à titular da marca.
